Terms of Use & End-User License Agreement

This is the agreement between you and Dictamio governing your use of the Dictamio macOS application ("the Software"). By downloading, installing, or using the Software, you agree to these terms. If you don't agree, don't use the Software.

1. License grant

Dictamio is licensed, not sold. Purchasing a license gives you a perpetual, non-exclusive, non-transferable right to install and use the Software, subject to the seat limit of your tier:

"Non-transferable" means you can't sell, gift, or transfer your license key to another person. Moving your own license between your own Macs is fine, and supported — deactivate a Mac you're no longer using via the self-service web portal to free up a seat for another one.

This license covers the Software only. We retain all ownership, copyright, and intellectual property rights in the Software; nothing here transfers ownership of the Software to you.

2. The 14-day trial

New installs get a 14-day full-featured trial — every feature unlocked, no limitations. At the end of the trial, dictation locks until you activate a purchased license key.

3. Purchases and payment

Polar.sh acts as the Merchant of Record and seller of record for all Dictamio purchases. This means Polar — not Dictamio — is the seller you're contracting with for the transaction itself, is responsible for calculating and remitting applicable sales tax/VAT, and processes and stores your payment details under its own terms and privacy policy. Dictamio never receives or stores your card details; we only receive the order confirmation and a license key is issued to you as a result.

4. Refunds

You may request a full refund within 14 days of purchase, no questions asked. Request it directly through Polar's order confirmation, or by emailing hello@dictamio.com with your order details. Once a refund is issued, your license key is deactivated.

5. Updates policy

Your purchase includes one year of minor and patch updates from your purchase date — bug fixes, performance improvements, and incremental feature additions delivered via the in-app Sparkle updater. Your license entitles you to use the version of the Software available as of your purchase, plus any updates released within that first year, forever — updates are never required to keep the app working.

Major version upgrades released after that window (or beyond what your included year covers) are optional and may be offered as a separately priced upgrade. Your existing licensed version will keep working whether or not you choose to buy an upgrade — you are never forced to pay again to keep using what you already bought.

6. Acceptable use

You agree not to:

• Reverse engineer, decompile, or disassemble the Software, except to the extent applicable law expressly permits despite this restriction
• Redistribute, resell, sublicense, or share the Software or your license key with anyone beyond your own licensed seats
• Circumvent, disable, or interfere with license activation, validation, or seat enforcement
• Use the Software for any unlawful purpose

7. Disclaimer of warranties

The Software is provided "as is" and "as available," without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

In particular: speech transcription accuracy varies by speaker, accent, environment, microphone quality, and language, and is not guaranteed to be error-free. Dictamio is a productivity tool, not a substitute for professional proofreading, review, or judgment in contexts where accuracy is critical (legal, medical, financial, or otherwise high-stakes documents). Always review dictated text before relying on it.

8. Limitation of liability

To the maximum extent permitted by law, Dictamio's total liability to you for any claim arising from your use of the Software will not exceed the amount you actually paid for your license. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, business, or profits, even if advised of the possibility of such damages.

9. Termination

We may terminate or suspend your license if you materially breach these terms — for example, by sharing your license key, attempting to circumvent seat enforcement, or other fraudulent use. Termination for the reasons above does not entitle you to a refund of any purchase already made outside the standard 14-day refund window described in Section 4.

10. Governing law

These terms are governed by the laws of [YOUR JURISDICTION], without regard to conflict-of-law principles. Any disputes will be resolved in the courts of that jurisdiction.

11. Changes to these terms

We may update these terms from time to time. If we do, we'll update the "Last updated" date above and, for material changes, note it in the app's release notes. Continued use of the Software after a change means you accept the updated terms.
